Overview
If you sell products on Rivly that are shipped to or sold in California, you must follow the requirements of California Proposition 65 (Prop 65). This law requires businesses to notify California consumers when products may expose them to certain chemicals known to cause cancer, birth defects, or other reproductive harm.
As a Rivly seller, you’re responsible for providing accurate and compliant Prop 65 warnings for your listings. These warnings help keep shoppers informed and ensure your business complies with state law.
Your Responsibilities as a Rivly Seller
For all new and existing product listings, you must:
-
Determine if a Prop 65 warning applies
- Review your products and materials to identify whether any chemicals listed by the California Office of Environmental Health Hazard Assessment (OEHHA) are present.
- You can view the full list at www.P65Warnings.ca.gov.
-
Provide the correct Prop 65 warning in the Rivly Seller Portal
- Add the required warning directly through the Rivly Seller Portal.
- Do not send warnings or labels to Rivly by email or other methods.
-
Use manufacturer or supplier information if available
- If you are not the manufacturer, you must use the Prop 65 warning provided by the product’s manufacturer, supplier, or distributor.
- You are still responsible for ensuring the warning is correct and up to date.
-
Update listings when required
- If you receive a notice from Rivly Product Compliance or from a court requiring you to use specific Prop 65 language, you must update your listings promptly using the provided instructions. If you need custom Prop 65 warning for any reason, please reach out to Rivly Seller Support.
About Proposition 65
Proposition 65 (the Safe Drinking Water and Toxic Enforcement Act of 1986) is a California law that requires businesses to provide clear warnings when their products may expose people to chemicals known to cause cancer or reproductive harm.
OEHHA maintains and updates a list of over 900 such chemicals.
These warnings are not safety ratings; they are consumer information notices required by California law. For details and resources, visit www.P65Warnings.ca.gov.
